Prison sentences imposed again for subsidy fraud

The district court of Rosenheim sentenced two managing partners of two road haulage companies to 10 months' imprisonment on probation each. Both shareholders also received - in addition to the repayment of the wrongly received subsidies amounting to about 90,000 euros - a separate fine of 14,000 euros each. Both partners are thus considered to have a criminal record.

In the context of the harmonisation of tolls, both shareholders wanted to receive subsidies unjustly. In the years 2009 to 2011, they submitted funding applications for the "further training" funding programme and invoiced further training measures that did not actually take place.

Since a chairman of the board and an office manager of a CET provider ordered or issued fictitious invoices and lists of participants that were submitted to the FOPH, they were sentenced to fines of EUR 4,800 and EUR 1,800 respectively for complicity in fraud.

In another completed criminal case, the Rosenheim District Court also sentenced the limited partner of a road haulage company to a total suspended prison sentence of 9 months.

In the years 2010 to 2012, she also submitted funding applications for the funding programme "Further Training" and billed for further training measures that did not actually take place and were to be substantiated with bogus invoices and falsified lists of participants. In addition to the suspended prison sentence, the applicant had to repay the wrongfully applied for funding in the amount of almost 50,000 EUR.
